Terms of Use

These terms are an agreement between you and Indigle ("we", "us"), based in Gorakhpur, Uttar Pradesh, India. They apply when you use indigle.com and when you subscribe to Indigle School ERP (the "Service"). By using the website or registering your school, you accept these terms, our Privacy Policy, and our Refund Policy.

1. Who can use the Service

You must be at least 18 years old. If you register on behalf of a school, trust, or company, you confirm that you are authorised to accept these terms for it, and "you" includes that organisation.

2. Your account

  • Give us accurate details when you register, and keep them up to date.
  • Keep your password secret. You are responsible for everything done through your account, including by staff you give access to.
  • Tell us straight away at support@indigle.com if you think someone has accessed your account without permission.

3. Plans, prices, and payment

  • Plans, features, and prices are listed on our pricing page. Prices are in Indian Rupees. Applicable taxes, such as GST, are charged as shown at checkout or on your invoice.
  • Subscriptions are paid in advance for the period you choose (monthly or yearly). Payments are processed by Razorpay.
  • Your school's account is set up after your payment is confirmed. Your billing period starts on that date.
  • Subscriptions do not renew or charge you automatically. To keep using the Service, pay for the next period before the current one ends.
  • We may change our prices. A new price applies only from your next billing period, never to a period you have already paid for.

4. No refunds

All payments are final and non-refundable. This includes unused time, unused features, and cancellations part-way through a billing period. Our Refund Policy explains this in full, including what happens if you are charged by mistake.

5. Cancelling

You can cancel at any time by emailing support@indigle.com from your account email. Cancellation takes effect at the end of the period you have paid for, and you keep access until then.

6. Suspension and termination

We may suspend or close your account if:

  • your billing period has ended and you have not paid for the next one;
  • you seriously or repeatedly break these terms; or
  • we must do so to comply with the law or to protect the Service or other users.

Where it is reasonable, we will warn you first and give you time to fix the problem. Suspension or termination under this section does not entitle you to a refund.

7. Acceptable use

You must not:

  • use the Service for anything unlawful, or to harass or harm anyone;
  • upload data you have no right to use, or content that is malicious, such as viruses;
  • try to access accounts, data, or systems you are not authorised to access;
  • copy, resell, or reverse engineer the Service, or use it to build a competing product;
  • overload or disrupt the Service, for example through automated scraping.

8. Your school's data

  • Data you put into Indigle School ERP, such as student, parent, and staff records, belongs to you. We use it only to provide the Service to you, as described in our Privacy Policy.
  • You are responsible for collecting that data lawfully. This includes giving the required notices and, for students under 18, getting verifiable consent from a parent or guardian as the Digital Personal Data Protection Act, 2023 requires.
  • For 30 days after your subscription ends you can ask us for an export of your data. After that we may permanently delete it, except where the law requires us to keep it.

9. Our intellectual property

Indigle owns the website, the Service, and all related software, designs, and content. While your subscription is active, we give you a limited, non-exclusive, non-transferable right to use the Service for your school's own operations. If you send us feedback or suggestions, we may use them freely.

10. Availability and changes to the Service

We work to keep the Service available and secure, but we do not promise it will be uninterrupted or error-free. We may carry out maintenance, and we may improve or change features. If we remove a major feature that is part of your plan, we will tell you in advance.

11. Third-party services

Some parts of the Service rely on others, such as Razorpay for payments and WhatsApp for messaging. Their own terms apply when you use them, and we are not responsible for their services.

12. Disclaimer

Apart from the commitments in these terms, the website and the Service are provided "as is". To the extent the law allows, we make no other promises, for example that the Service will suit a particular purpose. You remain responsible for checking important outputs such as report cards, fee records, and attendance before relying on them.

13. Limitation of liability

To the extent the law allows:

  • we are not liable for indirect or consequential loss, such as lost profits, lost revenue, or lost opportunities; and
  • our total liability to you for any claim is limited to the amount you paid us for the Service in the 12 months before the claim arose.

Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud.

14. Indemnity

You agree to cover our losses and reasonable legal costs if a third party makes a claim against us because of data you uploaded without the right to do so, or because you broke these terms or the law.

15. Changes to these terms

We may update these terms. When a change is material, we will update the date above and email account holders before it takes effect. If you keep using the Service after that, the new terms apply. If you do not agree, you can cancel as described in section 5.

16. Governing law and disputes

These terms are governed by the laws of India. Please contact us first so we can try to resolve any dispute informally. If we cannot, the courts at Gorakhpur, Uttar Pradesh have exclusive jurisdiction.
